By accessing or using Yaad2Yaad ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Yaad2Yaad is the marketing name of Yaad2Yaad Delivery Services, Ltd., a company incorporated in Jamaica. References to "Yaad2Yaad," "we," "our," or "us" in these Terms refer to Yaad2Yaad Delivery Services, Ltd. If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including vendors, customers, delivery riders, and any other parties who access or use the Service.

2. Description of Service

Yaad2Yaad is a delivery platform that connects small businesses with delivery riders to facilitate the delivery of goods and services in Jamaica. We provide a platform for vendors to request delivery services and for riders to fulfill those requests.

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service.

4. Vendor Responsibilities

As a vendor using our Service, you agree to:

  • Provide accurate information about your business and products
  • Ensure all items are properly packaged and ready for delivery
  • Provide accurate delivery addresses and contact information
  • Pay all applicable fees in a timely manner
  • Comply with all applicable laws and regulations
  • Not use the Service for illegal or unauthorized purposes

5. Delivery Riders

If you are a delivery rider using our Service, you agree to:

  • Provide accurate information about your vehicle and qualifications
  • Maintain valid licenses and insurance as required by law
  • Handle all deliveries with care and professionalism
  • Deliver items to the correct address in a timely manner
  • Follow all traffic laws and safety regulations
  • Report any issues or incidents immediately

6. Fees and Payment

We charge fees for our delivery services. All fees are displayed before you confirm a delivery request. Fees may vary based on distance, delivery type, and other factors.

6.2 Payment Processing

Payments are processed through secure third-party payment processors. By using our Service, you agree to their terms and conditions.

6.3 Refunds

7. Prohibited Uses

You may not use our Service:

  • For any illegal purpose or to solicit others to perform illegal acts

  • To impersonate or attempt to impersonate the company, employees, or other users

  • To deliver prohibited items (e.g., illegal substances, weapons, hazardous materials)

8. Limitation of Liability

Yaad2Yaad acts as an intermediary platform connecting vendors and delivery riders. We are not responsible for:

  • The quality, safety, or legality of items being delivered
  • The accuracy of information provided by vendors or riders
  • Loss, damage, or delay of items during delivery
  • Accidents or incidents involving delivery riders
  • Disputes between vendors and riders

To the maximum extent permitted by law, Yaad2Yaad shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless Yaad2Yaad and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Yaad2Yaad Delivery Services, Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.
